Meskipun AXIS Membantah, Pinjam Pulsa Tetap Riba
Setelah sekian lama berlalu, layanan AXIS Pinjam Pulsa baru mendapat sorotan dari BRTI (Badan Regulasi Telekomunikasi Indonesia). Layanan ini dianggap sebagai layanan rentenir karena mengambil keuntungan dari pinjaman. Kemarin saya sudah membahas bahwa keuntungan atau riba yang diambil dari layanan AXIS pinjam pulsa ini kurang lebih 25 persen.
AXIS Pinjam Pulsa, tidak lain hanyalah sebuah rentenir.
BRTI mengatakan bahwa sebelumnya telah ada operator lain yang berkonsultasi tentang masalah pinjam pulsa itu, yakni Telkomsel. Namun BRTI menolak usulan telkomsel dengan alasan yang sama. Menurut BRTI, pihak AXIS sepertinya tidak menyimak hasil konsultasi Telkomsel dengan BRTI tersebut. Layanan AXIS Pinjam Pulsa sendiri muncul pertengahan Desember 2012 lalu dan gencar diiklankan di televisi.
Pada periode BRTI sebelumnya sudah ditolak mentah-mentah. Ternyata saat ini pengembang aplikasi ini masih saja bergerilya melalui para operator. Kabarnya mendekati jajaran direksi operator agar layanannya mulus berjalan. Kita ingatkan operator jangan memuluskan layanan tersebut karena alasan persaingan.
Nonot Harsono, anggota komite BRTI.
Menilik dari pernyataan bapak Nonot diatas, dapat kita duga bahwa layanan ini tidak diselenggarakan oleh operator sendiri, melainkan dari pihak ketiga. Maka dari itu masuk akal jika layanan ini memiliki “fee” karena dari situlah si pihak ketiga mendapatkan keuntungan. Pihak AXIS sendiri menolak disebut memberikan layanan rentenir oleh BRTI. Menurut pemahaman mereka, riba itu berarti bunga yang terus bertambah dan memiliki jatuh tempo. AXIS Pinjam pulsa menerapkan layanan fee tetap dan tidak ada jatuh tempo, maka dari itu menurut mereka bukan riba.
Kalau pinjam pulsa, hari ini kita pinjam, mau dibayar besok, minggu depan, bulan depan, ya tetep service charge-nya Rp 500.

Tidak peduli apakah pengembalian itu bersifat langsung, dicicil, tambahannya tetap atau beranak, semuanya tetap adalah riba. Meskipun kelebihan pengembalian itu hanya 1 sen, tetap dianggap riba. Lebih jelasnya bisa membaca Al-Fatawa Al-Kubra III halaman 146-147.
